Official Rules
1. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. SWEEPSTAKES SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS. MUST BE A LEGAL RESIDENT OF THE 50 UNITED STATES OR D.C., 18 YEARS OF AGE OR OLDER AND HAVE INTERNET ACCESS AS OF 8/1/07. VOID OUTSIDE THE 50 UNITED STATES AND D.C. AND WHERE PROHIBITED. To enter: Beginning 12:00:01 a.m. ET on 8/1/07, visit www.energizer.com/fittowin and follow the instructions posted to complete and submit an entry. Entries must be received by 11:59:59 p.m. ET on 11/30/07. Limit one (1) entry per person/household/mail address per week. If more than one entry is received from the same person, household or email address in a given week, all such entries received will be disqualified. In the event of a dispute as to the identity of an entrant, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder, as well as any other proof of eligibility that Sponsor may request. Energizer Inc. ("Sponsor") is not responsible for : (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, undelivered, inaccurate or not received by Sponsor for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries; (iii) destruction of or unauthorized access to, or alteration of, entries; or (iv) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or any other causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes. All incomplete or otherwise non-conforming entries will be disqualified. Sponsor is further not responsible for: (i) incorrect or inaccurate entry or prize claim information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Sweepstakes, or for any other errors of any kind, whether technical, network, printing, typographical, human or otherwise, in any Sweepstakes-related materials or in the announcement of prizes/prize winners; or (ii) misrepresentation, cheating or fraud by any entrant. If any of the foregoing malfunctions, errors, defects or acts render the Sweepstakes incapable of operating as planned, Sponsor, at its sole discretion, may suspend or cancel this Sweepstakes immediately.
All entries become the exclusive property of the Sponsor and will not be returned or acknowledged except as provided herein. Any attempts by an individual to access the site via a bot script or other brute-force attack will result in that individual's e-mail address becoming ineligible, and the entry/entries submitted by that email address becoming void. . If Sponsor, in its sole discretion, determines that an individual is tampering or attempting to tamper with the Sweepstakes or website, such individual will be disqualified. Sponsor reserves the right to suspend or terminate this Sweepstakes without notice if, in Sponsor's sole discretion, the Sweepstakes becomes infected or otherwise corrupted or if the Sweepstakes otherwise cannot operate as planned; in such event, Sponsor will select winners in a random drawing from among all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor, or in any other manner deemed fair and equitable by Sponsor. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges, which shall be final, binding and conclusive on all matters relating to this Sweepstakes. Sweepstakes starts at 12:00:01 am ET on 8/1/07 and ends at 11:59:59 pm ET on 11/30/07. Any information collected by registering to enter the Sweepstakes shall be used only in a manner consistent with these Official Sweepstakes Rules.
2. WEEKLY PRIZES: A total of one-hundred-forty-four (144) Weekly Prizes will be awarded, as follows: Thirty-six (36) Magazine Subscriptions: Each week, two (2) winners will each receive a one-year magazine subscription to one of the following magazines: Shape Magazine, Prevention Magazine, Total Health and Wellness Magazine, Men's Journal, Exercise and Health Magazine, or Best Life Magazine. Approximate Retail Value (ARV): $15.00 each. The winner will choose the specific magazine he/she would like to subscribe to. One-hundred-eight (108) Energizer Pedometers: Each week, six (6) winners will each receive an Energizer pedometer. ARV: $3 each. Total ARV of all Weekly Prizes: $864.00.
Odds of winning a Weekly Prize depend on number of eligible entries received prior to each weekly drawing. Limit one (1) Weekly Prize per person/household/email address for the entire Sweepstakes period; however, Weekly Prize winners will still be eligible for, and included in, the Grand Prize Drawing. All non-winning weekly entries will be carried over into the following week's Weekly drawing and also into the Grand Prize drawing.
3. WEEKLY DRAWINGS: Each Friday beginning 8/3/07 and ending 11/30/07, potential prizewinners will be selected in a random drawing conducted by an independent judging agency from among all eligible entries received prior to the drawing. Each potential magazine prizewinner will be notified by mail at the address listed on his/her Official Entry Form. Please allow approximately 6-8 weeks for shipment of Weekly Prizes following verification. In the event of a potential winner's disqualification for any reason, Sponsor will award the corresponding prize to an alternate potential winner in a random drawing from among the remaining eligible entries received.
4. GRAND PRIZES: A total of three (3) Grand Prizes will be awarded. One (1) Grand Prize winner will receive (1) Treadmill (ARV: $3,062); a second Grand Prize winner will receive (1) Elliptical Machine (ARV: $2,301); and the third Grand Prize winner will receive one (1) Recumbent Bike (ARV: $1,528). Sponsor, alone, will determine the specific prize that will be awarded to each individual Grand Prize winner. Odds of winning a Grand Prize depend upon the total number of eligible entries received throughout the entire Sweepstakes entry period.
TOTAL ARV of all Grand Prizes: $6,891. TOTAL ARV of all Prizes in this Sweepstakes: $7,755.
5. GRAND PRIZES DRAWING: A random drawing to select the Grand Prize winners from among all eligible entries received will be held on or about 12/5/07 by an independent judging organization. Potential prizewinners will be notified by mail. Please allow approximately 6 to 8 weeks for shipment of Grand Prizes following verification of eligibility. In the event of a potential winner's disqualification for any reason, Sponsor will award the corresponding prize to an alternate potential winner in a random drawing from among the remaining eligible entries received.
6. ELIGIBILITY: Sweepstakes is open only to legal U.S. residents currently living in the 50 United States or DC who are 18 years of age or older and have Internet access as of 8/1/07. Employees, officers and directors of the Sponsor, it's parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and members of the immediate families (defined for these purposes as including parents, spouse, children, siblings and grandparents, and the respective spouses of any of the foregoing, regardless of where they reside) or households (whether related or not) of any of the above, are NOT eligible to participate.
7. OTHER CONDITIONS: Prizes are non-transferable, non-assignable and may not be redeemed for cash or otherwise substituted except as provided herein. Sponsor reserves the right to substitute a prize with cash or another prize of equal or greater value in the event the advertised prize becomes unavailable for any reason. All income taxes on prizes are the sole responsibility of each winner. If a prize is won by a minor, it will be awarded on the minor's behalf to his/her parent or legal guardian, who must sign all required documents. Sponsor is not responsible for inability of winner to accept prize in accordance with these rules. Grand Prize winners (or their parents or legal guardians, as applicable) will be required to complete an Affidavit of Eligibility and Liability/Publicity Release (where permitted). Weekly Magazine Prize winners (or their parents or legal guardians, as applicable) will be required to complete an Address Attestation form. All required documents must be returned within seven (7) days of receipt or the prizewinner will be disqualified and an alternate winner will be randomly selected from among the remaining eligible entries received. By accepting a prize in this Sweepstakes, each winner (or his/her parent or legal guardian, as applicable) consents to the use of winner's name, photographs, biographical information, voice recordings and likenesses for advertising or publicity purposes by Sponsor in commerce and in any media worldwide without additional compensation or permission, where permitted by law.
8. RELEASE OF LIABILITY: By entering, all entrants (or their parents or legal guardians, as applicable) agree to release and hold harmless Sponsor, and each of Sponsor's parent companies, affiliates, subsidiaries, and the officers, directors, agents, employees of each of the foregoing, and all others associated with the development and execution of this Sweepstakes (collectively, the "Released Parties"), from and against any and all liability with respect to, or in any way arising from or in connection with, participation in this Sweepstakes and/or the acceptance, possession or use of any prizes that may be awarded to them, including but not limited to liability for personal injury, bodily injury, death, damages or loss of any kind. By accepting prizes, winners (or their parents or legal guardians, as applicable) acknowledge and agree that the Sponsor, and each of Sponsor's parent companies, affiliates, subsidiaries, and the officers, directors, agents, employees of each of the foregoing, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including without limitation, its quality, mechanical condition or fitness for a particular purpose.
